Terms of Service

These Terms of Service (“Terms”) govern your access to and use of kachigloves.com and any purchase from Kachi Gloves LLC, doing business as Kachi Gloves (“Kachi Gloves,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms and the policies linked below. If you do not agree, do not use the site or purchase our products.

1. Eligibility and accounts

You must be at least the age of majority in your place of residence, or use the Services with the consent of a parent or legal guardian. Information you provide must be accurate, current, and complete. You are responsible for keeping your account credentials secure and for activity conducted through your account.

2. Products and site information

We work to describe and display our products accurately. Colors, materials, proportions, and appearance may vary slightly because of screens, photography, natural material variation, and the handmade nature of certain products. We may update product information, correct errors, limit quantities, or discontinue products. If an error affects an order, we will provide the remedies required by applicable law.

3. Orders and acceptance

Submitting an order is an offer to purchase. An order is accepted only when we confirm acceptance and successfully process payment. We may decline or cancel an order for lawful reasons, including suspected fraud, pricing or inventory errors, or inability to fulfill the order. If we cancel after payment, we will issue the applicable refund.

4. Custom and personalized products

You are responsible for reviewing and approving the complete rendered build sheet or final specifications. Production begins only after that approval. Changes requested after approval may be impossible or may require additional charges and delivery time. Custom and personalized products are final sale except when the product is defective, damaged in transit, does not match the approved specifications because of our error, or applicable law provides a non-waivable remedy.

You represent that you have the right to provide and authorize our use of any names, numbers, logos, artwork, or other materials submitted for a custom order. We may decline content that we reasonably believe violates law or another party’s rights.

5. Prices, payment, taxes, and promotions

Prices are shown in the currency displayed at checkout and may change before an order is placed. Shipping charges, discounts, taxes, duties, and other applicable charges are shown at checkout when available. You authorize us and our payment providers to charge the payment method you submit. Promotions may have additional terms and may not be combined unless expressly stated.

6. Shipping and delivery

Shipping times are estimates and are not guaranteed. Carrier delays, customs processing, weather, and other events outside our control may affect delivery. International customers are responsible for duties, taxes, brokerage fees, and import requirements unless checkout expressly states otherwise. 7. Returns, refunds, and exchanges

Returns, refunds, and exchanges are governed by our Refund Policy. Nothing in these Terms limits a consumer right that cannot legally be waived.

8. Craftsmanship guarantee

Manufacturing defects are covered by the Kachi lifetime craftsmanship guarantee, subject to the terms stated in our Refund Policy. Normal wear, misuse, improper storage, and unauthorized alterations are not manufacturing defects. Any rights provided by this guarantee are in addition to non-waivable rights under applicable law.

9. Acceptable use

You may use the site only for lawful personal or business purposes consistent with these Terms. You may not interfere with the site’s security or operation, introduce malicious code, scrape or copy the site without permission, impersonate another person, violate intellectual-property or privacy rights, submit unlawful or abusive content, or use the site for fraud or other unlawful activity.

10. Intellectual property

The site and its content—including text, product designs, photographs, graphics, logos, video, and software—are owned by or licensed to Kachi Gloves and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the site for its intended purpose. No other right or license is granted.

11. Feedback and user content

If you voluntarily submit reviews, suggestions, photos, or other feedback, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting Kachi Gloves, subject to applicable law and our Privacy Policy. You represent that you have the rights needed to grant this license.

12. Third-party services and Shopify

Our store is hosted by Shopify. Purchases are made directly from Kachi Gloves, not Shopify. The site may also link to or use services operated by third parties. We are not responsible for third-party content or services, and your use of them may be governed by separate terms and privacy notices.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. Privacy questions and rights requests may be sent to privacy@kachigloves.com.

14. Disclaimers

To the fullest extent permitted by law, the site and Services are provided “as is” and “as available.” Except for express written warranties or guarantees we provide and rights that cannot legally be waived, we disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free access to the site.

15. Limitation of liability

To the fullest extent permitted by law, Kachi Gloves and its officers, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, or business opportunity arising from the Services or these Terms. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid to Kachi Gloves for the product or service giving rise to the claim. These limits do not apply where prohibited by law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kachi Gloves and its officers, employees, agents, contractors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your violation of another party’s rights.

17. Suspension and termination

We may suspend or terminate access to the Services when reasonably necessary to protect the site, our customers, or our legal rights, or when these Terms are materially violated. Provisions that by their nature should survive termination will remain in effect.

18. Severability, waiver, assignment, and entire agreement

If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, reorganization, sale, or transfer of our business. These Terms and the policies incorporated by reference form the entire agreement regarding your use of the Services.

19. Governing law

These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. You and Kachi Gloves consent to venue and personal jurisdiction in the state and federal courts located in Miami-Dade County, Florida, except where applicable law permits proceedings elsewhere.

20. Changes to these Terms

We may update these Terms from time to time for operational, legal, or regulatory reasons. The updated version will be posted on this page with a revised effective date, and we will provide any notice required by law. Changes apply prospectively unless applicable law permits otherwise.
